PRIVACY POLICY

Last updated:  May 2, 2025

FOLM (“FOLM,” “we,” “our,” or “us”) respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy describes the types of information we collect, how we use that information, the circumstances in which we may disclose it, and the rights and choices you have regarding your information. By visiting folmethod.com or using any of our classes, memberships, websites, mobile sites, applications, or other online services (collectively, the “Services”), you acknowledge that you have read and understand the practices described in this Policy.

1. Information We Collect

We collect information that can identify you directly or indirectly (“Personal Information”). The information we collect generally falls into four broad categories:

  1. Contact and Account Information.  When you create an account, purchase a class or membership, join our mailing list, or otherwise interact with us, we collect information such as your name, postal address, email address, telephone number, login credentials, and any communications you send to us.

  2. Transaction Information.  If you buy classes, memberships, retail items, or other products or services, we collect details of the transaction, such as the date, purchase amount, class or product description, and the last four digits of your payment card. Full card data is processed securely by our payment processor (e.g., Stripe) and never stored on our servers.

  3. Fitness‑Related Information.  When you book or attend a class, fill out an intake or waiver, or consult with an instructor, you may choose to share information about your fitness goals, cycle phase, injuries, or other physical conditions. This information helps us personalize instruction and ensure your safety in class.

  4. Device, Usage, and Marketing Information.  When you visit our website or open an email from us, we automatically collect data such as your IP address, browser type, referring URL, the pages you view, time spent on pages, links you click, and the date and time of each visit. We also collect cookie and pixel data (see “Cookies” below) and may record whether you open or interact with our marketing communications. If you interact with us on social media, we may collect your handle and publicly available profile details.

We do not knowingly collect or solicit Personal Information from anyone under the age of 16. If we learn that we have collected such information, we will delete it as quickly as possible.

2. How We Use Your Information

We use Personal Information for the following purposes:

  • To provide the Services.  We process bookings, manage memberships, deliver classes, and maintain your account.

  • To personalize your experience.  We tailor class recommendations, cycle‑sync guidance, and promotional offers based on your preferences, cycle phase, and past interactions.

  • To communicate with you.  We send class confirmations, account updates, policy changes, customer‑service replies, and, with your consent, marketing messages such as newsletters, special offers, and event invitations.

  • To improve and secure our studio and website.  We analyze usage patterns, monitor performance, fix bugs, enhance features, and ensure the security of our systems and premises.

  • To comply with legal obligations.  We retain purchase records for tax and accounting, respond to lawful requests, and protect the rights, property, or safety of FOLM, our clients, and others.

  • On other legal grounds.  Where applicable, we rely on contractual necessity, our legitimate interests, your consent, or a legal obligation to process Personal Information.

3. Sharing and Disclosure of Information

We disclose Personal Information only as described in this Policy:

  • Service Providers.  We share information with trusted third‑party vendors who perform functions on our behalf, such as payment processing, scheduling software, email marketing platforms, website analytics, cloud hosting, and IT support. These providers have access only to the information necessary to perform their services and are bound by confidentiality obligations.

  • Business Transfers.  If we ever merge with, acquire, or are acquired by another company, or if FOLM’s assets are transferred, Personal Information may be transferred as part of that transaction, subject to customary confidentiality standards.

  • Legal Requirements.  We may disclose information if required to do so by law or in the good‑faith belief that such action is necessary to comply with a legal obligation, protect and defend our rights or property, act in urgent circumstances to protect the personal safety of studio clients, or protect us against legal liability.

  • With Your Consent.  We may share information for any other purpose disclosed to you and with your explicit consent.

We do not sell Personal Information and do not share it for cross‑context behavioral advertising as defined by the California Consumer Privacy Act.

4. Cookies and Tracking Technologies

Our website uses first‑ and third‑party cookies, pixels, and other tracking technologies to keep you logged in, remember preferences, analyze site traffic, and measure marketing campaign effectiveness. Most browsers allow you to control cookies through their settings. If you disable cookies, some features of the Services may not function properly.

5. Data Retention

We keep Personal Information for as long as it is reasonably necessary for the purposes described in this Policy, or as required by law, whichever is longer. When information is no longer needed, we will securely delete or anonymize it.

6. Security Measures

We employ administrative, technical, and physical safeguards to protect Personal Information. These include encryption in transit (TLS), firewalls, role‑based access controls, and regular security audits. While we strive to use commercially acceptable means to protect your data, no method of transmission or storage is completely secure.

7. Your Rights and Choices

Depending on where you live, you may have specific rights regarding your Personal Information:

  • California Residents.  Under the CCPA/CPRA, you may request to know, delete, or correct Personal Information we hold about you, and you may opt out of certain data practices.

  • EU/EEA and UK Residents.  Under the GDPR, you may request access to, rectification or erasure of, restriction of, or objection to our processing of your Personal Data, and you have the right to data portability and to lodge a complaint with a supervisory authority.

  • All Users.  You may opt out of marketing communications at any time by clicking “Unsubscribe” in any email or contacting us at privacy@folmethod.com.

We will verify your identity before fulfilling any request and will respond within the timeframe required by applicable law.

8. International Data Transfers

FOLM is located in the United States. If you are located outside the U.S., your information may be transferred to, processed, and stored in the U.S. or other jurisdictions that may not provide the same level of data protection as your home country. Where required, we use Standard Contractual Clauses or other approved mechanisms to protect data transfers.

9. Third‑Party Sites

Our Services may contain links to third‑party websites or services (e.g., Instagram, YouTube). We are not responsible for the content or privacy practices of those sites. We encourage you to review their privacy policies before providing any information.

10. Changes to This Privacy Policy

We may modify this Privacy Policy from time to time. If we make material changes, we will post the updated Policy on our website and indicate the effective date. Your continued use of the Services after any changes constitute your acceptance of the revised Policy.
